GENERAL TERMS AND CONDITIONS OF SALE

Set forth below is the contractual document that governs the purchase of products through the website www.asignumjewelers.com // shop.asignumjewelers.com, commercial property of VIGINTIDUO with NIFB17899451, (from now on “ARS SIGNUM”). The acceptance of this document implies that the user:

A) Has read, understood and understands whats here exposed.

B) Is a person with sufficient capacity to purchase

C) That assumes all the obligations here explained

These conditions shall be valid indefinitely and will be applicable to all contracts or purchases made through the website www.asignumjewelers.com and shop.asignumjewelers.com.

ARS SIGNUM reserves the right to unilaterally modify these general conditions, not affecting the goods or promotions that were acquired prior to the modification.

1. Regulations.

These General Terms and Conditions have been written in accordance with the established in the following regulations:

a) Law 7/1998 about general terms and conditions.

b) Royal Decree 1906/1999 which regulates telephone and electronic contracting with general conditions in development of the art. 5.3 of the Law 7/1998.

c) Law 7/1996 of Regulation of the Retail Commerce.

d) Royal Decree Law 14/1999 regulator of the electronic signature.

e) Royal Legislative Decree 1/2007, from 16th november, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws. f) Law 34/2002, from 11th july, of Services of the Information Society and of Electronic Commerce.

IMPORTANT: All the users of the web, independently of their condition of visitors or registered users, remain subject to the Legal Notice. Also, every client, before providing consent, will declare that he has read and meet these conditions, to which it will remain subject and will expressly accept its terms, in order to be considered formalized the purchase transaction.

 
2. Products on sale.

 
ARS SIGNUM offers jewelry and personal ornamentation through a web platform of electronic commerce.

ARS SIGNUM will specify the characteristics of the products for sale, as the producer has provided them or put on the market available to consumers.

ARS SIGNUM will inform the customer the retail price of each product, expressed in euro (€) or dollar ($), with applicable taxs included.

ARS SIGNUM reserves the right to add and remove any product or service in the shop, at any time. Unless otherwise provided, new products will be subject to the provisions of the General Conditions of Sale from that moment. Customer must take into account that some of the offered products are of handmade artisan production, reason for which there is the possibility that at the time of processing an order, these are not available in stock. In this case, ARS SIGNUM will inform the customer to ensure that they have knowledge of it.

All products of ARS SIGNUM are equipped with a safety anti tampering label. This label does not prevent the product from being proven. The destruction or manipulation of the safety label will imply that customer may not exercise his right of claim or return of the product.

3. Purchase / check out process.

ARS SIGNUM puts at the disposal of the customer the following procedure of sequential purchase to formalize the operation:

1. The customer will be able to choose the products that he wishes and he will be able to add them to its shopping cart both from the product tab, as well as from other places enabled for this purpose, like the Facebook-integrated shop. The customer will be able to review at any time the status of his cart, obtaining information of the selected products, their price and the cumulative total of purchase intent. At this stage of the process, the customeris free to add or delete the products he wants in his shopping cart.

The customer will be shown a list with all the products included in his order. It will indicate the unit price and the total value of his shopping cart, excluding transport.

At this stage of the process, the customer will still be able to add or delete items from his cart, to his free election Using a diagram, the customer will be informed at all times in which step of the purchase process he is.

2. To start the next step, the payment process, by using the corresponding option, the customer must declare that he has read and accepts the Privacy Policy and Terms and Conditions of ARS SIGNUM, visible at any moment in the website and now also especially accessible through the corresponding link.

3. If the customer decides to continue with the process, he will be able to be identified / log in as customer or register as new customer, providing the required info for this purpose.
If the customer has already registered as a client in the database of ARS SIGNUM, it will only be necessary for him to identify himself / login through his email and password to continue with the payment process.

The customer will also have the option to continue the payment process as a visitor, without the need to login or register as a user, providing only an email address in order to receive his invoice, in addition to provide all the personal and bank data required in this payment process.

4. Next, the customer will provide the delivery address of of the products he wants to acquire, which does not have to coincide with its usual domicile or billing address, providing all the data required in order to minimize possible returns.

5. On the basis of the information provided by the client, ARS SIGNUM  knows already at this point of the process all the variables involved in the calculation of the price of transport to destination.
Once calculated the system will display the final amount to pay (with secure basic transportation included).
If the customer decides at this moment that the information provided is correct and complete, he will be asked to provide his consent to complete the purchase transaction. Once given this consent, the order may not be modified.

6. Given the consent, the customer will formalize the payment of the operation through the use of the banking payment gateway. ARS SIGNUM reserves the right to change the gateway and payment systems in function of his needs, at any time and without prior notice.

7. Once finished with all these steps, the customer will receive by email an invoice with all the details of his purchase. This information will also be available in the order history of his account.

8. If the customer purchases a product considered special and of limited production, or out of stock, the delivery deadline can extend until 20 calendar days. ARS SIGNUM will inform the customer by mail about their lack of stock or limited production, and its consequent delay in delivery.

4. Payment Methods

ARS SIGNUM only accepts payment with credit cards (Visa and Mastercard) or Pay-Pal.

The payment system of  ARS SIGNUM is attached to the Stripe and Pay-Pal payment gateway. Customer data will be encrypted according to the SSL (Secure Socket Layer) protocols, thereby guaranteeing the security and confidentiality of them.

5. Shipment and delivery

ARS SIGNUM will manage the national and international shipments to the shipping address provided by the customer during the purchase process. There won’t be any shipping to PO boxes in any country of the world. Shipping costs will be calculated based on the shipping address provided.

ARS SIGNUM will select the transport agency that suits them in every moment and for every destination in order to obtain a service as effective and reliable possible and shall issue the order within the 10 calendar days following receipt of the same (except for the weekend or holidays that will make it the first following business day) and after being confirmed the payment, provided that the products are available and there are no circumstances of force majeure that prevent it.

The selected transport agency will deliver the order within the period that is established according to the destination and type of service used. In all cases, once delivered the goods to the carrier, the system will send the customer an email with a code that will allow the customer to track a shipment through the carrier's web.
ARS SIGNUM is not responsible for delays in delivery caused exclusively for reasons attributable to the transport agency or factors unforeseeable and uncontrollable for them.

As a general rule, the transport agencies make several attempts to deliver the goods. If it ultimately is returned and credited the number of delivery attempts, the customer shall have no right to be refunded the amount of his purchase. In any case, ARS SIGNUM won’t ever manage the forwarding of the goods.

On international shipments, shipping costs include transportation, the basic insurance and origin customs clearance. Except for shipments to the United States or the European Community, any import charges or other taxes (tariffs) that could be generated in the Customs Office of destination are not included. The recipient will be who will take care of all these expenses and taxes.

The customer must take special care in everything related to the specific legislation of the country of destination of shipment with respect to the importation of the items purchased. ARS SIGNUM accepts no responsibility nor exercises control over these specific policy conditions of the country of destination.

ARS SIGNUM will not be liable in any way for any delays that might occur in the customs clearance, or if the local authorities decide to seize in full or in part the content included in a shipment. We will not accept any type of claim for this concept.



6. Withdrawal and return of an order.

In case that one or several products arrive damaged as a consequence of the transport, it will be necessary that the recipient points it out in a writing in the delivery note that the carrier will deliver at the moment of receiving the shipment, accompanied by the recipient signature. Then, it will be necessary to communicate it to ARS SIGNUM, in writing, within a maximum of seven working days from the date of receipt, explaining the facts in detail. It is necessary that the recipient preserves the damaged product without breaking or manipulate the security tamper-evident label, within its original packaging, avoiding any manipulation, alteration or use.
As soon as the formalities, procedures and checks are done, and in a maximum term of thirty days from the date of communication, ARS SIGNUM will refund the money of the damaged product through a transfer to the credit card that was used at the time the purchase. Once made the refund of the money, ARS SIGNUM reserves the right to claim for the damaged product (covering to its charge the expenses of return for that product).

If the received products differ from the original order, it will be necessary for the customer to communicate it in a writing to ARS SIGNUM, within a maximum of seven working days from the date of receipt. The recipient must preserve the product subject of claim without breaking the security tammper-evident label, within its original packaging, avoiding any kind of manipulation, alteration, or use. Once ARS SIGNUM receives the defective or wrong product and makes all the appropriate procedures and checks, and within a maximum period of thirty days from the date of communication, ARS SIGNUM will refund the money of the defective or wrong products through a transfer to the credit card that was used at the time of purchase. Once made the refund of the product, in case that the error is attributable to ARS SIGNUM, ARS SIGNUM will cover to its charge the expenses of return for that product.

If for some reason other than the above, the customer decides to return any product, excluding the products considered special (custom products, tailored to a size, or different from those offered on the website), will have seven business days from the date of receipt of the shipment. It will be necessary that the client communicates it previously to ARS SIGNUM, in a writing, in the stated term. The recipient must preserve the product subject of claim without breaking the security tammper-evident label, within its original packaging, avoiding any kind of manipulation, alteration, or use. The customer will have to return the product in perfect conditions, going to its charge both the first shipping costs as the return (which he should directly manage), as well as the customs expenses, if any. Once ARS SIGNUM receives the returned product and makes all the appropriate procedures and checks, ARS SIGNUM will refund the amount by a transfer to the credit card that was used at the time of purchase, in the maximum term of thirty days from the date of reception of the product in its facilities.

The right of withdrawal will be excluded in those cases in which by the nature of the content will be impossible to carry out, without prejudice to the claim for damages and losses, or when the goods returned to the store or its packaging are not complete and in perfect condition.

ARS SIGNUM offers on its website a ring size guide, so that the customer can calculate by itself, in an approximate way, its ring size. This guide is for reference only, and as noted in the guide, ARS SIGNUM will not be liable for any errors resulting from its use.


7. Applicable legislation and Jurisdiction.

The preparation, application and interpretation of these general conditions of contract by any arbitral or judicial authority are subject to the regulations established in the Spanish legal system.

The involved parts or parties are obliged to try to resolve disputes that may arise in an arbitration organ in the province of Girona that could issue a binding award.

If the matter takes the judicial route for the resolution of any dispute between the customer and ARS SIGNUM, the parties agree to submit the resolution to the courts and tribunals of the province of Girona, renouncing any other general or specific jurisdiction that may be applicable.

In the international commerce, the parties expressly submit themselves to the Spanish legal system in regard to the application and interpretation of these General Conditions, and to the Spanish arbitrators and judicial organs of the city of Girona as jurisdiction to resolve possible litigation.
This jurisdiction remains established without detriment to the application of the 44/2001 CE Regulation and other international norms signed by the Spanish State on the subject of jurisdictions and laws applicable to consumption in the international trade.

CONDICIONES GENERALES DE CONTRACTACIÓN

A continuación se expone el documento contractual que regirá la contratación de productos a través del sitio web www.asignumjewelers.com // shop.asignumjewelers.com, propiedad de la mercantil VIGINTIDUO con NIFB17899451, (en adelante “ARS SIGNUM”). La aceptación de este documento comporta que el usuario:

a) Ha leído, entiende y comprende lo aquí expuesto.

b) Que se una persona con capacidad suficiente para contratar.

c) Que asume todas las obligaciones aquí dispuestas.

Estas condiciones serán válidas indefinidamente y serán aplicables a todas las contrataciones realizadas a través del sitio web www.asignumjewelers.com y shop.asignumjewelers.com.

ARS SIGNUM se reserva el derecho de modificar unilateralmente estas Condiciones Generales, sin que ello pueda afectar a los bienes o promociones que fueron adquiridos previamente a la modificación.


1. Normativa.

Estas Condiciones Generales han sido redactadas de conformidad con lo establecido en la normativa siguiente:

a) Ley 7/1998 sobre condiciones generales de contratación.

b) RD 1906/1999 por lo que se regula la contratación telefónica o electrónica con condiciones generales en desarrollo del art. 5.3 de la Ley 7/1998.

c) Ley 7/1996 de Ordenación del Comercio Minorista.

d) Real Decreto Ley 14/1999 regulador de la firma electrónica.

e) Real Decreto Legislativo 1/2007, de 16 de noviembre, por el que se aprueba el texto refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias.

f) Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y de Comercio Electrónico.

IMPORTANTE: Todos los usuarios de la web, independientemente de su condición de visitantes o usuarios registrados, quedan sujetos al Aviso Legal. Además, todo cliente, antes de prestar su consentimiento, declarará que ha leído y conoce estas condiciones, a las que quedará sujeto y aceptará expresamente sus términos, al objeto de considerar formalizada la operación de compra.


2. Productos a la venta.

ARS SIGNUM ofrece joyería y ornamentación personal a través de una plataforma web de comercio electrónico.

ARS SIGNUM especificará las características de los productos a la venta, tal como el productor los haya suministrado o los ponga en el mercado a disposición de los consumidores.

ARS SIGNUM informará al cliente el precio de venta al público de cada producto, expresado en euros(€) o dólares ($), con los impuestos aplicables incluidos.

ARS SIGNUM se reserva el derecho de añadir y retirar cualquier producto o servicio de la tienda virtual, en cualquier momento. A menos que se disponga de otro modo, los productos de nueva incorporación quedarán sujetos a las disposiciones de las condiciones generales de contratación desde ese momento.
El cliente debe tener en cuenta que algunos de los productos sugeridos son de producción artesanal, motivo por el que existe la posibilidad de que en el momento de tramitar un pedido, éstos no estén disponibles en stock. En este supuesto, ARS SIGNUM así lo informará al cliente, a fin de que tenga conocimiento.

Todos los productos de ARS SIGNUM van equipados con una etiqueta de seguridad. Dicha etiqueta no impide que el producto sea probado. La destrucción o manipulación de la etiqueta de seguridad comportara que el cliente no pueda ejercer su derecho de reclamación o devolución del producto.


3. Procedimiento de compra.

ARS SIGNUM pone a disposición del cliente el siguiente procedimiento de compra secuencial para formalizar la operación:

1. El cliente podrá escoger los productos que desee y los podrá añadir a su cesta de la compra tanto desde la ficha del producto, como desde otros lugares habilitados al objeto. El cliente podrá consultar en cualquier momento el estado de su cesta, obteniendo la información de los productos seleccionados, su precio y el total acumulado de intención de compra. A esta altura del proceso, el cliente es libre de añadir o eliminar los productos que quiera de su cesta.

Se le mostrará un listado con todos los productos incluidos en su pedido. También se le indicará el precio unitario y el valor total de su cesta, sin incluir el transporte.

A esta altura del proceso, el cliente aún podrá añadir o eliminar productos de su cesta, a su libre elección. Mediante un diagrama, el cliente estará informado en todo momento en que los pasos del procedimiento de compra se encuentran.

2. Para iniciar el procedimiento de compra mediante la opción correspondiente, el cliente deberá declarar que ha leído y que acepta la Política de Privacidad y las condiciones de ARS SIGNUM visible en cualquier momento de acceso a la web y ahora también especialmente accesible a través del link correspondiente.

3. Si el cliente decide continuar con el proceso, podrá identificarse como cliente -en el supuesto de que aún no lo fueran facilitando todos los datos que le sean requeridas. Si el usuario ya consta como inscrito como cliente en la base de datos de ARS SIGNUM, sólo será necesario que se haya identificado previamente mediante su correo electrónico y la contraseña (password) para continuar con el proceso de compra.

El cliente también tendrá la opción de continuar el procedimiento como visitante, sin necesidad de identificarse o registrarse como usuario, proporcionando únicamente una dirección de correo electrónico para poder recibir su factura, además de todos los datos personales y bancarios requeridos en el proceso de compra.

4. A continuación, el cliente informará la dirección de entrega de los productos que desea adquirir, que no tiene por qué coincidir con su domicilio habitual (y de facturación), facilitando todos los datos requeridos al objeto de minimizar posibles devoluciones.

5. A partir de la información aportada por el cliente, ARS SIGNUM ya conoce en este momento del proceso todas las variables que intervienen en el cálculo del precio del transporte hasta destino. Una vez calculado el sistema mostrará el importe final a pagar (con seguro de transporte básica incluida).

Si el cliente decide en este momento que la información aportada es correcta y completa, se le pedirá que preste su consentimiento para finalizar la operación de compra. Una vez dado este consentimiento, el pedido no podrá ser modificado.

6. Prestado el consentimiento, el cliente formalizará el pago de la operación mediante el uso de la pasarela de pago bancario. ARS SIGNUM se reserva el derecho de cambiar la pasarela y los sistemas de pago en función de sus necesidades, en cualquier momento y sin preaviso.

7. Realizados todos estos pasos, el cliente obtendrá por correo electrónico y de forma inmediata una factura con todos los detalles de su compra. Esta información también será consultable en el histórico de pedidos de su cuenta.

8. Si el cliente compra un producto considerado especial y de producción limitada, o fuera de stock, el plazo de entrega se alargara hasta los 20 días naturales. En ese caso ARS SIGNUM advertirá al cliente, via email, de su falta de stock o producción limitada, y su consiguiente demora en el plazo de entrega.


4. Forma de pago.

ARS SIGNUM sólo acepta el pago con tarjetas de crédito (Visa y Mastercard) o Pay-Pal.

El sistema de pago de ARS SIGNUM, está adscrito a la pasarela de pagos de Pay-Pal y Stripe. Los datos del cliente serán encriptados según los protocolos SSL (Secure Socket Layer), garantizando de esta manera la seguridad y confidencialidad de las mismas.


5. Transporte y entrega.

ARS SIGNUM gestionará los envíos nacionales e internacionales a la dirección de envío facilitada por el cliente durante el proceso de compra. No se realizará ningún envío a apartados de correos de ningún país del mundo. Los gastos de transporte se calcularán en función de la dirección de envío facilitada.

ARS SIGNUM seleccionará la agencia de transportes que más le convenga en cada momento y para cada destino al objeto de conseguir un servicio lo más eficaz y fiable posible y expedirá el pedido dentro de los 10 días naturales (máximo) siguientes a la recepción de la misma (a excepción del fin de semana o festivos que lo hará el primer día hábil siguiente) y después de ser confirmado el pago, siempre y cuando los productos estén disponibles y no haya circunstancias de fuerza mayor que lo impidan. La agencia de transportes seleccionada entregará el pedido dentro del plazo que tenga establecido según el destino y tipo de servicio utilizado.
En todos los casos, una vez entregada la mercancía al transportista, el sistema enviará al cliente un correo electrónico con un código que le permitirá hacer un seguimiento del envío a través de la web del transportista.ARS SIGNUM no se responsabilizará de las demoras en la entrega ocasionados exclusivamente por causas imputables a la agencia de transportes o factores imprevisibles e incontrolables que no tenga el deber de soportar.

Por norma general, las agencias de transporte realizan varios intentos de entrega de la mercancía. Si finalmente ésta resulta devuelta y se acreditan los varios intentos de entrega, el cliente no tendrá ningún derecho a que le sea reintegrado el importe de su compra. En cualquier caso, ARS SIGNUM no gestionará nunca el reenvío de la mercancía.

En los envíos internacionales, los gastos de envío engloban el transporte, el seguro básico y el despacho de aduanas de origen. Exceptuando los envíos a Estados Unidos o Comunidad Europea, no quedan incluidos en ningún caso los gastos de importación ni tampoco los otros impuestos (aranceles) que se pudieran generar en la aduana de destino. Será el destinatario quien se hará cargo de todos estos gastos e impuestos, tanto si la mercancía es entregada o no, así como también su tramitación.

El cliente deberá tener un especial cuidado en todo lo que señale la normativa específica del país de destino del envío con respecto a la importación de los artículos adquiridos. ARS SIGNUM no acepta ninguna responsabilidad ni ejerce control sobre estas condiciones normativas específicas del país de destino.

ARS SIGNUM no será responsable en ningún caso de las demoras que pudieran producirse en el despacho aduanero, ni si las autoridades locales decidieran incautar total o parcialmente el contenido incluido en un envío. No se aceptará ningún tipo de reclamación por este concepto.


6. Desistimiento y devolución de un pedido.

En caso de que uno o varios productos llegaran deteriorados a consecuencia del transporte, será necesario que el destinatario lo haga constar por escrito en el albarán de entrega que le entregará el transportista en el momento de recibir el envío, acompañado de su firma. Después, será necesario que lo comunique a ARS SIGNUM, por escrito, en un plazo máximo de siete días hábiles desde la fecha de recepción, explicando los hechos con detalle. Es necesario que el destinatario conserve el/los producto/s deteriorado/s sin romper/manipular la etiqueta de seguridad, dentro de su envase original, evitando cualquier manipulación, alteración o uso. Una vez realizadas las gestiones y comprobaciones oportunas, y dentro de un plazo máximo de treinta días desde la fecha de comunicación, ARS SIGNUM reembolsará el dinero de los productos deteriorados mediante una transferencia a la tarjeta de crédito que se utilizó en el momento de efectuar la compra. Una vez realizado el reembolso del dinero, ARS SIGNUM se reserva el derecho a reclamar los productos deteriorados (corriendo a su cargo los gastos de devolución de los mismos).

Si los productos recibidos difieren del pedido original, será necesario que el cliente lo comunique por escrito a ARS SIGNUM, en un plazo máximo de siete días hábiles desde la fecha de recepción. El destinatario deberá guardar el/los producto/s objeto de reclamación sin romper la etiqueta de seguridad, dentro de su envase original, evitando cualquier tipo de manipulación, alteración o uso. Una vez ARS SIGNUM reciba el producto defectuoso o erróneo y hechas las gestiones y comprobaciones oportunas, y dentro de un plazo máximo de treinta días desde la fecha de comunicación, ARS SIGNUM reembolsará el dinero de los productos erróneos mediante una transferencia a la tarjeta de crédito que se utilizó en el momento de efectuar la compra. Una vez realizado el reembolso del dinero, En caso de que el error sea imputable a ARS SIGNUM correrá con los gastos de devolución.

Si por alguna razón distinta de las anteriores, el cliente decide devolver algún producto, menos los productos considerados especiales (productos personalizados, a medida o distintos a los ofrecidos en la web), dispondrá de siete días hábiles desde la fecha de recepción del envío. Será necesario que el cliente lo comunique previamente a ARS SIGNUM, por escrito, dentro del plazo indicado. El destinatario deberá guardar el/los producto/s sin romper/manipular la etiqueta de seguridad y dentro de su envase original, evitando cualquier tipo de manipulación, alteración o uso. El cliente deberá devolver este/los producto/s en perfectas condiciones, yendo a su cargo tanto los gastos del primer envío como las de la devolución (que deberá gestionar directamente), así como también los gastos aduaneros, si los hubiera. Una vez recibido y hechas las comprobaciones oportunas, ARS SIGNUM reembolsará su importe mediante una transferencia a la tarjeta de crédito que se utilizó en el momento de efectuar la compra, dentro del plazo máximo de treinta días desde la fecha de recepción del/los producto/s en sus instalaciones.

Queda excluido el derecho de resolución (desistimiento) en aquellos casos en que por la naturaleza del contenido de las prestaciones sea imposible llevarla a cabo, sin perjuicio de la reclamación de los daños y perjuicios sufridos o cuando la mercancía devuelta al almacén o su embalaje no estén completos y / o en perfecto estado.

ARS SIGNUM ofrece en su página web una guía para que el cliente pueda calcular por sí mismo, de manera aproximada, su talla de anillo. Ésta guía és solo de referencia, y tal y como se advierte en la misma, ARS SIGNUM no podrá ser responsabilizado de cualquier error resultado del uso de la misma.


7. Legislacióny Jurisdicción aplicables.

La confección, aplicación e interpretación de estas Condiciones Generales de contratación por parte de cualquier órgano arbitral o judicial quedan sujetas a la normativa establecida en el ordenamiento jurídico español.

Las partes se obligan a intentar solucionar las controversias que puedan surgir ante un órgano arbitral de la provincia de Girona que pueda emitir un laudo vinculante.

Si el asunto toma la vía judicial, para la resolución de cualquier controversia entre el cliente y ARS SIGNUM, las partes acuerdan someter la resolución de la misma a los juzgados y tribunales de la Provincia de Girona, con renuncia a cualquier otro fuero general o especial que les pudiera corresponder.

En el tráfico internacional, las partes se someten expresamente al ordenamiento jurídico español en cuanto a la aplicación e interpretación de estas Condiciones Generales y los árbitros y órganos judiciales españoles de la ciudad de Girona como fuero para resolver posibles litigios judiciales. Este fuero queda establecido sin perjuicio de la aplicación del Reglamento 44/2001 CE y otras normas internacionales suscritas por el Estado Español en materia de fueros y leyes aplicables a consumo en el comercio internacional.
